This document is general and not specific to Illinois. Designated agency is the presumption in Illinois and dual agency is allowed with informed consent. Subagency (seller side and buyer side agent only owe duties to seller) and ‘non-agency’ (a situation where the licensee is the only agent involved, i.e. “transactional agent” or “facilitator”) are prohibited in Illinois.
