Litigation Notices Mailed to Consumers

A post card mailer has been sent to consumers around February 1, 2024.

You may get questions about these mailers regarding proposed settlement agreements between ReMax, Keller Williams or Anywhere and the class action plaintiffs in the Burnett, Moehrl and Nosalek cases.

  • NAR is not involved in the proposed settlements.
  • The mailer discusses possible steps for those who may be in the settlement classes.

What should you do if asked about the mailers?

  • Suggest that the consumer consult with an attorney, and/or
  • direct them to the website listed on the mailer.

DOJ Statement of Interest in MLS PIN Litigation

Nosalek v MLS PIN, et al. is a lawsuit challenging the policy and practice of cooperative compensation between listing and buyer brokers. While not an NAR affiliated MLS, the concepts and policies are like those of wholly owned REALTOR® MLSs.

The Department of Justice (DOJ) is seeking to insert its opinion regarding the MLS PIN’s cooperative compensation practices prior to the court approving a proposed settlement among the parties.

Motion to Dismiss Ruling in Batton I Case

Batton v the National Association of Realtors et al. (Batton I, originally known as Leeder) was filed in 2021, alleging that homebuyers (as opposed to sellers) paid inflated costs because of the cooperative compensation policy.

The case was originally dismissed but refiled, and NAR’s motion to dismiss this case has been pending for over a year.
