Governor Pritzker’s most recent Executive Order, 2020-30, extends the restriction on evictions issued in previous Executive Order 2020-10, with a few important additions:

  • While the previous Executive Order (EO) prohibited law enforcement officers from enforcing eviction orders during the Gubernatorial Disaster Proclamation, the new EO also prohibits property owners from commencing residential eviction matters. However, an eviction action may be commenced if the tenant poses a direct threat to the health and safety of other tenants, an immediate and severe risk to property, or a violation of any applicable building code, health ordinance, or similar regulation.

As with the previous EO, although a landlord is prohibited from evicting a tenant during the Gubernatorial Disaster Proclamation, the tenant is not relieved from any obligation under their lease or rental agreement, including amounts owed for rent or any other obligation they might have pursuant to their lease or rental agreement.

  • During the Gubernatorial Disaster Proclamation, law enforcement officers are now also prohibited from enforcing orders of eviction for non-residential premises, unless the tenant has been found to pose a direct threat to the health and safety of other tenants, an immediate and severe risk to property, or a violation of any applicable building code, health ordinance, or similar regulation.

As with the restriction on enforcement of residential evictions, the Executive Order does not relieve any individual or entity from the obligation to pay rent or comply with any other obligation they might have pursuant to a lease or rental agreement.”
