The bill would dictate terms of retainage provisions in private, business-to-business contracts between commercial real estate developers and contractors. Illinois REALTORS® argues that the parties should be allowed to negotiate their own mutually beneficial contract terms and that SB 3052 would make real estate development more expensive and more difficult in Illinois.

So even though the Illinois House narrowly advanced the bill in the final days of the spring legislative session, the governor can still veto this unwarranted intrusion into the private market.
