NAR Announces Settlement in Buy-Side Litigation

On Friday, April 10, 2026, the National Association of REALTORS (NAR) announced it is opting in to a proposed settlement agreement in Tuccori et al. v. At World Properties et al., a class action buy-side antitrust lawsuit. NAR is not a defendant in this case, but the allegations are like those in Batton et al. v. National Association of REALTORS® et al. and is intended to release the claims in Batton.

What does this mean to me?

  • This proposed settlement seeks to finalize antitrust litigation just about everywhere.
  • There will be no additional practice changes for REALTORS® that were agreed to in the sell-side Sitzer Burnett litigation:
    • No ON-MLS broker to broker offers of compensation.
    • The requirement for written buyer brokerage agreements (Illinois Real Estate License Act requires written brokerage agreements for essentially all forms of licensed real estate brokerage); and,
    • Obvious disclosures that all compensation is negotiable.
  • The proposed settlement protects these groups:
    • REALTOR® members.
    • State and Local REALTOR® Associations.
    • REALTOR® Affiliated MLSs.
    • Non-REALTOR® Affiliated MLSs; and,
    • Brokerages with REALTOR® principals which have not previously settled similar litigation.
  • The agreed NAR settlement amount is $52.25 million, and the first payment will be due sometime after June 2028 (after completion of the seller-side Sitzer Burnett payments).
